Terms of Service for Metashifts Hypnosis

These Terms of Service (“Terms”) govern your access to and use of the website(s) located at metashifts.com, s.metashifts.com, or any related domains (the “Site”) and the purchase and use of digital hypnosis audio downloads and related products (the “Products”) offered by Metashifts Hypnosis (“we”, “us”, or “our”).

By accessing or using the Site, or by purchasing or downloading any Products, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase any Products.

1. Use of the Site and Products The Site and Products are provided for your personal, non-commercial use only. You must be at least 18 years old to use the Site or purchase Products.

2. License Grant for Products Upon successful purchase and payment, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to:

Download the hypnosis audio file(s) (typically in MP3 or similar format) for personal use only.
Make one (1) archival backup copy solely for your personal use.
Listen to the Product(s) on your personal devices.

You may not:

Copy, reproduce, distribute, sell, rent, lease, lend, share, upload to file-sharing sites, or otherwise make the Product(s) available to others.
Use the Product(s) for any commercial purpose.
Modify, reverse engineer, or create derivative works from the Product(s).
Remove or alter any copyright, trademark, or other proprietary notices.

All Products remain our exclusive property, protected by U.S. and international copyright and other intellectual property laws.

3. Hypnosis Audio Products – Important Disclaimers and Safety Warnings Metashifts Hypnosis audio downloads (which may incorporate Ericksonian hypnosis patterns, binaural beats, isochronic tones, and other relaxation techniques) are intended solely for personal relaxation, stress reduction, self-improvement, focus enhancement, and entertainment purposes.

They are not medical treatments, therapies, psychological counseling, or substitutes for professional medical, psychological, psychiatric, or therapeutic care. They do not diagnose, treat, cure, mitigate, or prevent any disease, disorder, condition, or symptom.

Do not listen to any hypnosis audio while driving, operating heavy machinery, or engaging in any activity requiring full attention, alertness, or physical coordination, as they may induce deep relaxation, drowsiness, or altered states of awareness.

If you have epilepsy, seizures, serious mental health conditions, are pregnant, under 18, or have any health concerns whatsoever, consult a qualified healthcare professional before listening.

You assume all risks associated with use of the Products. We are not liable for any adverse effects, outcomes, or experiences.

4. Purchases and Payment All purchases are final. Digital downloads are non-refundable, except in limited cases of verifiable technical delivery failure that we are unable to resolve within a reasonable time. Prices are in USD and exclude applicable taxes and fees. We may use third-party payment processors; their terms also apply to your transaction.

5. Delivery Products are delivered digitally (e.g., via secure download link, email, or account access) immediately or shortly after purchase confirmation. It is your responsibility to download and securely save files promptly. Download links may expire after a reasonable period (typically 30–90 days). We are not responsible for lost or unrecoverable files after successful delivery.

6. Intellectual Property All content on the Site and in the Products—including audio, text, graphics, trademarks (e.g., “Metashifts Hypnosis”), and other materials—is owned by Metashifts Hypnosis or its licensors and protected by applicable laws. Unauthorized use is strictly prohibited.

7. No Warranties The Site and Products are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, or non-infringement.

8. Limitation of Liability To the fullest extent permitted by law, Metashifts Hypnosis, its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Products, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid for the specific Product(s) giving rise to the claim.

9. Indemnification You agree to indemnify, defend, and hold harmless Metashifts Hypnosis and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site/Products, violation of these Terms, or infringement of any third-party rights.

10. Termination We may terminate or suspend your access to the Site, your account, or Products at any time, without notice, for any reason, including suspected violation of these Terms.

11. Governing Law and Dispute Resolution These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Site/Products shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue or forum inconvenience.

12. Changes to Terms We may update these Terms at any time. The updated version will be posted on the Site with a revised “Last Updated” date. Your continued use of the Site or Products after changes constitutes acceptance of the revised Terms.
